- 협상 시한 6시간 남은 시점까지 협약문 초안조차 완성 못해
- 오늘 발표된 제5차 의장 비문서, ‘플라스틱 오염 종식 → 플라스틱 오염으로부터 인간 건강과 환경 보호’로 협약 목적부터 흔들어
지난 월요일(11월 25일)부터 시작된 ‘플라스틱 오염 종식을 위한 국제 플라스틱 협약’ 마지막 협상인 제5차 정부간협상위원회(INC-5, 이하 ‘INC-5’)에 주어진 시간이 채 6시간도 남지 않았다. 계획된 일정대로라면 오늘(12월 1일)에 협상 결과가 나와야 한다. 그러나 협상장인 부산 벡스코에서 실시간으로 돌아가는 상황으로 짐작건대 ‘강력한 국제 플라스틱 협약’ 성안은 요원해 보인다. 녹색연합은 ‘플라스틱 원료 추출을 포함하여 생산 단계부터 플라스틱 생애 전 주기를 다루며 전 세계 국가가 지켜야 하는 법적 구속력을 가진 협약’ 성안을 다시 한 번 촉구한다.
‘강력한 국제 플라스틱 협약’을 만드는 과정에 함께하기 위해, 전 세계에서 옵저버만 2,200여 명이 부산에 모였다. 그러나 옵저버(Observer; 참관인) 참여를 완전히 막고 정부 대표단으로만 이뤄진 그룹별 비공개 회의를 진행한지 벌써 3일째다. 시민사회는 지난 며칠간 모든 회의가 비공개로 전환된 데에 답답해 하면서도 논의가 빠르게 진전될 수 있지 않을까 하는 일말의 희망을 품고 있었다. 그러나 그간 진행된 논의 결과를 모아 오늘 낮 13시 경에 발표한 제5차 의장 비문서를 확인한 지금, 나오는 건 한숨 뿐이다.
제5차 의장 비문서에서 강력한 협약에 대한 ‘낮은 의지’가 읽히는 부분은 크게 세 군데다.
첫째, 협약 목적을 규정하는 ‘제1조 목적’ 수위가 크게 낮아졌다.
애초에 유엔환경총회(UNEA) 5/14 결의안에서 합의한 본 협약의 성격은 분명하다. ‘플라스틱 오염 종식을 위한 법적 구속력 있는 국제 협약’이 그것이다. 그러나 오늘 발표된 제5차 의장 비문서에서 제안하는 목적은 ‘[플라스틱 생애 주기를 다루는 포괄적인 접근 방식을 기반으로 해양 환경을 포함한] 플라스틱 오염으로부터 인간의 건강과 환경을 보호하는 것’이다. 플라스틱 생애 전 주기를 포괄적인 방식으로 다룬다는 부분을 괄호 안에 넣은 건 차치하더라도, ‘플라스틱 오염 종식’이 아닌 ‘플라스틱 오염으로부터 인간 건강과 환경을 보호하는 것’으로 목적 수위가 대폭 낮아진 데에 큰 우려를 표한다. 이는 11월 29일 발표된 제4차 의장 비문서보다도 그 수위가 낮아진 것으로, ‘국제 플라스틱 협약’을 위해 3년 가까이 협상을 이어온 모든 과정을 부정하는 것과 다름 없다.
들째, 플라스틱 생산 및 공급을 다루는 ‘제6조 공급’ 조항이 아예 없어지다시피 했다.
협상장 안팎에서 이어진 치열한 논의를 바탕으로, 제4차 의장 비문서는 해당 조항에 대해 2가지 선택지를 제시했었다. 해당 조항을 아예 삭제하자는 1번 선택지와, 5개 세부 조항이 담긴 2번 선택지다. 만족할 만한 수위는 아니었으나, 생산 감축 관련 내용이 포함된 데에 시민사회는 긍정적으로 평가했다. 그러나 오늘 발표된 제5차 의장 비문서에서 제6조 2번 선택지 내 모든 세부 조항이 괄호 안에 담기면서, 논의가 원점으로 돌아갔다. 정부 협상단이 지난 며칠 동안 밤낮으로 비공개 협상을 진행한 결과가 이뿐인지 허탈하다. 1~5번 세부 조항이 모두 각각 괄호 안에 갇혔다는 사실은 이 조항들이 모두 살아남을 수도, 모두 사라질 수도 있다는 점을 시사한다. 후자일 경우 해당 조항을 삭제하자는 1번 선택지와 다를 바 없어진다.
셋째, 재정 메커니즘을 다루는 ‘제11조 재정 메커니즘’ 조항도 수많은 괄호로 뒤덮였다.
국제 플라스틱 협약이 체결된 후 실제로 각 국가에서 해당 내용이 실현되는 데에는 많은 자원이 필요하다. 특히 관련 기술·재정 지원이 필수인 저개발 국가에게 이 부분은 매우 중요하다. 협약이 체결된다 하더라도 이를 실현할 기술과 재정이 없다면 협약은 종이 쪼가리에 지나지 않을 것이다. 때문에 시민사회는 국제 플라스틱 협약만을 위한 재정 메커니즘 신설이 필수적이라고 주장해 왔다. 하지만 제5차 의장 비문서에는 해당 조항 내 15개 세부 조항이 모두 괄호 안에 갇혔다. 생산 감축 부분과 마찬가지로, 어떤 조항이 살아남고 어떤 조항이 사라질지 현재로서는 누구도 장담할 수 없다. 그야말로 모든 부분이 열린 결말로 남아 있어, 굳게 닫힌 회의장 문 안에서 그동안 어떤 식으로 협상이 이뤄졌는지 의심스럽다.
지금쯤이면 법률초안그룹(Legal Drafting Group) 검토를 거쳐 법률적으로 완결한 문안이 완성됐어야 하지만, 협상 시한을 6시간 남겨둔 지금 이시간까지도 모든 것이 안개 속이다. 녹색연합은 INC-5dp 참석한 전 세계 정부 협상단에게 다시 한 번 요청한다. ‘플라스틱 오염 종식’이라는 본래 목적을 잊지 않길 바란다. 그리고 생산 감축 없이 오염 종식은 불가능하다. 욕조 물이 넘치면 바닥을 닦을 게 아니라 수도꼭지를 잠가야 한다.

INC-5 Delegates Must Not Forget Its Original Purpose Of This Journey For Ending Plastic Pollution
– Delegates fail to finalize draft text with 6 hours left to wrap up the negotiations

With less than six hours left for the fifth session of the Intergovernmental Negotiating Committee (INC-5) on Plastic Pollution, which began this past Monday (November 25th) and is the final round of negotiations for the Global Plastics Treaty. According to the planned schedule, the results of the negotiations should be announced today (December 1st). However, judging from the situation at the venue, BEXCO in Busan, where the negotiations are taking place, it seems unlikely that a strong global plastics treaty will be drawn up. Green Korea United calls for the drafting of a legally binding agreement that covers the entire life cycle of plastics, including the extraction of raw materials, from the production stage, and that all countries around the world must abide by.
To participate in the process of creating a “strong international plastic convention,” more than 2,200 observers from around the world gathered in Busan. However, it has already been three days since the group-by-group closed-door meetings, which were conducted only by government representatives, completely prevented observers from participating. Civil society was frustrated that all meetings had been closed to the public over the past few days, but still had a glimmer of hope that the discussions could progress quickly. However, after reviewing the results of the discussions that have taken place so far and the fifth Chair’s Non-Paper, which was released at around 13:00 today, all that can be said is a sigh.
There are three main places in the 5th Chair’s Non-Paper where a “low level of commitment” to a strong agreement can be seen.
First, the level of the ‘Article 1. Objective’ that defines the purpose of the Global Plastics Treaty has been significantly lowered.
The nature of this Treaty, which was initially agreed upon in the UN Environment Assembly (UNEA) Resolution 5/14, is clear. It is a ‘legally binding international agreement to end plastic pollution’. However, the purpose proposed in the 5th Chair’s Non-Paper released today is ‘to protect human health and the environment from plastic pollution, including in the marine environment [based on a comprehensive approach that address the full life cycle of plastics]’. Even if we ignore the fact that the phrase “addressing the full life cycle of plastics” is included in parentheses, we are deeply concerned that the goal has been significantly downgraded from “ending plastic pollution” to “protecting human health and the environment from plastic pollution.” This is even lower than the level of the 4th Chair’s Non-Paper released on November 29th, and it is tantamount to denying the entire process of negotiations that have been ongoing for nearly three years for the Global Plastics Treaty.
Second, the ‘Article 6. [Supply][Sustainable Production]’ provision, which deals with the production and supply of plastics, has been almost completely removed.
Based on the intense discussions that took place both inside and outside the negotiating rooms, the 4th Chair’s text presented two options for the relevant provisions. Option 1 is to delete the relevant clause altogether, and option 2 is to include five sub-clauses. Although it was not satisfactory, civil society positively evaluated the inclusion of content related to production reduction. However, in the fifth Chair’s Non-Paper released today, all the detailed provisions in option 2 of Article 6 were enclosed in parentheses, returning the discussion to square one. It is disheartening that this is the result of the government negotiating team’s days and nights of closed-door negotiations over the past few days. The fact that all of the sub-clauses 1 to 5 are each enclosed in parentheses suggests that all of these clauses may survive or all of them may disappear. In the latter case, it would be no different from option 1, which calls for the deletion of the relevant clause.
Third, the ‘Article 11. Financial [Resources And] Mechanism’, which deals with the financial mechanism, is also covered with numerous parentheses.
Once the Global Plastics Treaty is signed, a lot of resources are needed to implement the contents in each country. This is especially important for developing countries, where relevant technical and financial support is essential. Even if this Treaty is signed, it will be nothing more than a piece of paper if there is no technology and finance to implement it. Therefore, civil society has argued that it is essential to establish a new financial mechanism exclusively for the Global Plastics Treaty. However, in the 5th Chair’s text, all 15 sub-clauses in the relevant clause were enclosed in parentheses. As with the production reduction section, no one can guarantee which provisions will survive and which will disappear at this point. It is doubtful how negotiations were conducted behind the firmly closed doors of the conference hall, as literally all parts remain open-ended.
By now, a legally complete draft should have been completed after review by the Legal Drafting Group, but even now, with six hours left until the deadline for negotiations, everything is still in the fog. Green Korea United once again requests the government delegates from around the world who attend INC-5 not to forget the original purpose, whic is ‘to end plastic pollution.’ And ending pollution is impossible without reducing production. When the bathtub overflows, you should not wipe the floor but turn off the faucet.
